The rule of law is a moral ideal that protects distinctive legal values such as generality, equality before the law, the independence of courts, and due process rights. I argue that one of the main goals of an international rule of the law is the protection of individual and state autonomy from the arbitrary interference of international institutions, and that the best way to codify this protection is through constitutional rules restraining the reach of international law into the internal affairs (...) of a state. State autonomy does not have any intrinsic value or moral status of its own. Its value is derivative, resulting from the role it plays as the most efficient means of protecting autonomy for individuals and groups. Therefore, the goal of protecting state autonomy form the encroachment of international law will have to be constrained by, and balanced against the more fundamental goal of an international rule of law, the protection of the autonomy of individual persons, best realized through the entrenchment of basic human rights. There are no moral entitlements with respect to pollution prior to legal conventions that establish them, or so I will argue. While some moral entitlements precede legal conventions, pollution is part of a category of harms against interests that stands apart in this regard. More specifically, pollution is a problematic type of harm that creates liability only under certain conditions. Human interactions lead to harm and to the invasion of others’ space regularly, and therefore we need an account of undue (...) harm as a basis of assigning legal protections and obligations to different agents, which creates standards for holding those agents responsible for harm. Absent such positive standards with respect to pollution at the domestic or international level, it does not make sense to hold agents responsible. This fact has two fundamental implications. First, contrary to what some defenders of environmental justice argue, we cannot hold people responsible for polluting without a system of legal rights in place that assigns entitlements, protections, and obligations, and second, contrary to what opponents of environmental regulation claim, the lack of moral entitlements to pollute creates room for quite extensive legal restrictions on people’s ability to pollute for the sake of the environment and human health. At the heart of the tension between state autonomy and international law is the question of whether states should willingly restrict their freedom of action for the sake of international security, human rights, trade, communication, and the environment. David Hume offers surprising insights to answer this question. He argues that the same interests in cooperation arise among individuals as well as states and that their interactions should be regulated by the same principles. Drawing on his model of dynamic coordination, I (...) will reconstruct the Humean case for developing international law into a more robust legal system and also highlight the limitation of Hume’s account of justice for such a reconstructive project. Hume’s lessons are enduring; we must strengthen the essential features of international law that allow states and individuals to reap the benefits of its protections, such as nonoptional rules that articulate a moral minimum, courts with compulsory jurisdiction, and stronger mechanisms of enforcement. International and domestic law offer a study in contrasts: States' legal obligations often depend on their consent to specific international legal norms, whereas domestic law applies to individuals with or without their consent; enforcement in international law is weak and, for many international treaties, non‐existent, whereas states spend considerable resources to create centralized coercive enforcement mechanisms; and international law is characterized by much less institutional differentiation and specialization of functions than domestic legal systems are. These differences have invited a number (...) of skeptical challenges to international law, 3 of which we explore in this essay. The first points to 1 or more of the deviations of international law's institutional structure from that of a modern state's legal system as a basis for denying that international law is really “law.” Central to the debates over international law's status as law are concerns about whether and why the concepts of law inherited from domestic legal systems should serve as the blueprint for theorizing law in general and international law in particular. The second skeptical challenge targets international law's legitimacy. It claims that we lack reasons to treat international legal norms or the exercise of political power by international institutions, as anything other than an attempt by states to advance their national interests. If this challenge succeeds, states and other subjects of international law have merely prudential reasons to comply with it rather than a moral duty to obey it. Following a brief description of recent debates over how we ought to understand the concept of legitimacy when used to assess international political practices or global governance, we survey several possible bases for a moral duty to obey or respect international law. These include state consent, instrumental accounts of legitimate authority, and global democracy. The third set of challenges focuses on the relationship between state sovereignty and international law. International rules and institutions often make demands for reform affecting the domestic law of a state in order to elicit compliance with international law. Skeptics argue that the rule of international law is incompatible with states' political self‐determination. Regardless of whether their defense of this claim ultimately succeeds, thoughtful engagement with it may well require us to rethink some of the fundamental concepts and normative ideals in political philosophy, including state sovereignty, democracy, individual rights, political authority, and political obligation. One of the most prevalent rationales for public healthcare policies is a human right to healthcare. Governments are the typical duty-bearers, but they differ vastly in their capacity to help those vulnerable to serious health problems and those with severe disabilities. A right to healthcare is out of the reach of many developing economies that struggle to provide the most basic services to their citizens. If human rights to provision of such goods exist, then governments would be violating rights without (...) doing anything wrong. I argue that such variable ability to provide healthcare depends not only on financial resources, but on institutional capacity, and that the latter represents a more fundamental challenge to the existence of a human right to healthcare than previously recognized. This challenge does not imply that government has no obligations to protect and improve the health of their citizens, but that it is best to think of such obligations as generated by conventional rights, namely rights arising from local legal and social conventions, which require governments to pursue health-related moral goals such as reducing suffering, closing opportunity gaps for the disadvantaged, and preventing the spread of contagious diseases. We need not think of such moral goals in terms of human rights. (shrink)

The use of private security companies by national governments is met with widespread skepticism. Less understood is the role these companies can play in international humanitarian interventions in the service of international organizations. I argue here that despite valid concerns about the use of such private entities, we should nonetheless see them as legitimate participants in efforts to secure human rights protection around the globe. In order to assess their legitimacy, we need to ensure, among other things, that they can (...) adhere to ethical standards when serving in humanitarian missions, that they can be held accountable when they fail to uphold the standard of justice enshrined in international law, and that their for-profit status does not have implications detrimental to humanitarian concerns. H. L. A. Hart proposed one of the most influential accounts of law, according to which law is a union of primary rules, which guide the behavior of the law’s subjects, and secondary rules, which guide officials in recognizing, changing, and interpreting primary rules. Writing at the end of the 1950s, Hart had serious doubts about whether international law meets the necessary criteria for a legal system. But there are several reasons to reconsider his position. One is that international law (...) has grown significantly since then, but a more important reason is that Hart provided an oversimplified description of the necessary and sufficient conditions for law provided by his account, and therefore of the nature of the international legal order. A proper understanding of Hart’s view gives us a richer and more accurate understanding of the essential features of law, but also a less precise yardstick by which to measure and characterize the various systems of rules, including international law. According to this new yardstick, international law fails to meet the criteria for a Hartian legal system, but for reasons other than those identified by Hart. (shrink)

The place occupied by Kant’s philosophical ideas in the reflections of the Russian philosopher, Nikolay Strakhov, needs further study. The material for a historical-philosophical reconstruction of Strakhov’s reception of Kant’s philosophy is the Russian thinker’s home library catalogue, his correspondence and his own philosophical works. Among Strakhov’s interlocutors were not only philosophers and natural scientists, but also writers, including Fyodor Dostoevsky, Leo Tolstoy and Afanasy Fet, who in many ways determined the cultural and intellectual horizon of the epoch. The many (...) years of correspondence with the last two writers went a long way to shape and develop Strakhov’s perception of Kant as a thinker. Indeed, without a virtual dialogue with Kant no modern philosophical system can be built. Strakhov’s reflections on the Kantian style of thinking, adoption of Kantian criticism as the model of epistemic analysis in many ways determined the features of his own philosophical work and became a catalyst of renewed interest in Russia in the Kantian philosophy in the last third of the nineteenth century. We give an exponential lower bound on the number of proof-lines in intuitionistic propositional logic, IL, axiomatised in the usual Frege-style fashion; i.e., we give an example of IL-tautologies A1,A2,… s.t. every IL-proof of Ai must have a number of proof-lines exponential in terms of the size of Ai. We show that the results do not apply to the system of classical logic and we obtain an exponential speed-up between classical and intuitionistic logic.

The article offers a rigorous explication of the intuitive notion of verisimilitude, I.E., Of the distance of a theory from the truth. The proposal is defended against charges of material inadequacy made by popper, Niniluoto, And miller.

It is well known that the manner in which a definitely descriptive term contributes to the meaning of a sentence depends on the place the term occupies in the sentence. A distinction is accordingly drawn between ordinary contexts and contexts variously termed non-referential, intensional, oblique, or opaque. The aim of the present article is to offer a general account of the phenomenon, based on transparent intensional logic. It turns out that on this approach there is no need to say (as (...) Frege does) that descriptive terms are referentially ambiguous or to deny (as Russell does) that descriptive terms represent self-contained units of meaning. There is also no need to tolerate (as Montague does) exceptions to the Principle of Functionality. The notion of an ordinary (i.e., non-intensional) context is explicated exclusively in terms of logical structure and it is argued that two aspects of ordinariness (termed hospitality and exposure) must be distinguished. We give an exponential lower bound on number of proof-lines in the proof system K of modal logic, i.e., we give an example of K-tautologies ψ₁, ψ₂,... s.t. every K-proof of ψi must have a number of proof-lines exponential in terms of the size of ψi. The result extends, for the same sequence of K-tautologies, to the systems K4, Gödel—Löb's logic, S and S4. We also determine some speed-up relations between different systems of modal logic on formulas of modal-depth one.

El Estado debe ser social y servir al ciudadano y a la sociedad. Se ha demostrado que el Estado debe participar en la regulación de la economía y la circulación monetaria. La estabilidad política en el nivel internacional se logra por el equilibrio multipolar y por la diversidad de los Estados soberanos y equitativos. (shrink)

The boundary between analytic and synthetic sentences is well definable. Quine’s attempt to make it vague is based on a misunderstanding: instead of freeing semantics from shortcomings found, e.g. in Carnap’s work, Quine actually rejects semantics of natural language and replaces it by behavioristically articulated pragmatics. Semantics of natural language as a logical analysis is however possible and it can justify hard and fast lines between analyticity and syntheticity.

Job crafting has been established as a bottom-up work design instrument for promoting health and well-being in the workplace. In recent years, the concepts of job crafting have been applied to the university student context, proving to be positively related to student well-being. Building on person-centered analyses from the employment context, we assessed approach study crafting strategy combinations and the relationships to students’ exhaustion, study engagement, and general well-being. Data from 2,882 German university students were examined, collected online during the (...) summer term in 2020. Using latent profile analysis, we found five distinct crafting groups, which showed discriminate validity with regard to emotional exhaustion, engagement, and well-being. The results underscore the positive role of study crafting for students’ health and well-being. They further indicate a less important role of increasing social resources for emotional exhaustion when combined with a moderate increase in structural resources and a moderate increase in challenging demands. Our findings imply that interventions to promote study crafting should be considered to promote student health and well-being. (shrink)

Prolonging working hours and presenteeism have been conceptualized as self-endangering coping behaviors in employees, which are related to health impairment. Drawing upon the self-regulation of behavior model, the goal achievement process, and Warr's vitamin model, we examined the antecedents and moderation effects regarding quantitative demands, autonomy, emotion regulation, and self-motivation competence of university students' self-endangering coping behaviors. Results from a cross-sectional survey of 3,546 German university students indicate that quantitative demands are positively related and autonomy has a u-shape connection with (...) self-endangering coping. Emotion regulation was shown to be a protective factor for prolonging working hours. Moreover, self-motivation moderated the relationship between quantitative demands and prolonging of working hours, but not in the assumed direction. Self-motivation showed a systematic positive relationship with prolonging of working hours, but no relationship with presenteeism. Autonomy moderated the relationship of quantitative demands with both self-endangering behaviors. We found no moderating effects for emotion regulation of quantitative demands or autonomy and self-endangering behaviors. Besides further practical implications, the results suggest that lecturers should design their courses accordingly with less time pressure and university students should be trained in the use of autonomy. Práce si klade za cíl porovnat vliv filosofického učení na pokrok společnosti a hospodářství s ohledem na vliv náboženství. Vliv filosofie je studován na historickém vývoji společnosti ve starověku a středověku. Jde o období, které bylo nejvíc ovlivněno náboženskými změnami, které vedly k různému společenskému vývoji v závislosti na volnosti v rozhodování. Tato teze je postupně doložena na vývoji antického Řecka, starověké Číny, arabského světa a středověké katolické Evropy. Tyto regiony procházely obdobími hospodářského vzestupu a úpadku podle toho, nakolik se (...) filosofii dařilo držet odstup od náboženských zásahů. Na vývoji Evropy je zároveň poukázáno na fakt, jakým způsobem znalosti antiky procházely dějinami přes jednotlivé regiony, které kladou důraz na rozvoj člověka. (shrink)

Quine claims that a) considering meaning as a separate object leads to mentalism and b) to overcome mentalism we have to accept an empirical analysis. The paper shows that a) is wrong and not accepting mentalism we can apply a logical, i.e., not empirical approach.

Práce si klade za cíl kriticky prozkoumat teorii J. S. Milla o rozlišení kvalitativní a kvantitativní charakteristice požitků (pleasure). Mill svoji teorii představil jako reakci na kritiku, že utilitární teorie vyhovuje jen zvířecí povaze lidské přirozenost a neuvažuje o vyšších schopnostech lidského ducha. Millova expozice teorie ale není v mnoha pasážích zcela jasná a průhledná. Práce se zaměřuje hlavně na prozkoumání problematického vztahu mezi kvantitativní stránkou a kvalitativní stránkou potěšení.

RESUMO O artigo discute os princípios fundamentais de elaboração do projeto e anotação de corpora de fala no âmbito da Escola Fonológica de São Petersburgo e fornece os exemplos de utilização de dados de vários corpora na pesquisa em fonética. Um dos princípios fundamentais é analisar as amostras em todos os níveis: desde o segmento até a entoação, incluindo as disfluências da fala. Durante a anotação fonética, sugerimos ouvir cada som isoladamente e confiar nos dados do espectrograma. Na anotação silábica, (...) é crucial considerar a ressilabificação. Durante a anotação prosódica, sugerimos confiar na percepção do ouvinte e analisar as curvas melódicas. Um corpus de fala que segue esses princípios é uma fonte valiosa de dados fonéticos, uma vez que os fatores segmentais e prosódicos estão em constante interação e não se pode analisar as unidades de um nível de anotação sem fazer referência aos outros. Starting bioethics in Russia we were motivated with the idea of the democratization of our society on a basic micro-social level. The country was swift enough to take several important steps in this direction on the macro-social level, i.e., to adopt a new constitution with guarantees of human rights and rights of ownership of private property, to elect the parliament and the president. But these modernizations in the Russian political facade did not sufficiently change the internal structure of the society–the (...) net of everyday relationships in the home, at work, at school, in hospitals and other places. One of the most brilliant philosophers of the Russian “silver age,” L.S. Frank, wrote in the beginning of the century that a tyrannical state grows out of tyrannical interpersonal relationships. Political revolution not grounded in a social evolution on the basic level of satisfying “simple” human economic, physical, and psychological needs could reproduce only the same totalitarian pattern under a new ideological label. Events resulting from the Bolshevik revolution in 1917 proved the wisdom of his statement. Russia could suffer the same fate today. (shrink)

The author discusses B.G. Yudin's image technoscience as having two contours, the external one dealing with science, business and society, and the internal one represented by laboratories. Together these two contours present a multidimensional net of relations between science and technology in conducting experiments, development of instruments (e.g. visualization tools), etc. The author argues that, in such a system, coordinated activity of the internal and the external contours is provided by a synergy of regulatory principles of truth, good and usefulness. (...) He discusses a case of synthetic biology which, as he argues, demonstrates that the internal and external contours of technoscience undergo a process of technologization. Technologization is understood as a transition from research techniques to systematic use of technologies. Biotechnologies are claimed to have a double socio-biological helix network structure. Each network is formed as a kind of ad hoc "factory" and is aimed at solving specific research problems. (shrink)

The paper tries to shed light on the development of the phenomenological thinking of two founding fathers of phenomenology: Brentano and Husserl. Through the criticism of psychologism it approaches the classical modern thesis articulated already by Descartes in his Meditations, namely that our inner being and consciousness are given to us more directly than the being of nature. This psychic/physical dualism as well as holding the psychic independent of its physical environment (i.e. Husserlian preserving a transcendental position), were ever more (...) inconsistent. It was approaching the objectified soul in the same exact way as the nature that paved the way to empirical psychology. Husserl’s aiming at so called “pure psychology”, even though underpinned by the transcendental subjectivity, resulted in the rise of a phenomenological stream, which hoped to justify its claims by recourse to the original encounter of humans with things within the pre-scientific frame of natural world. The paper is based on transparent intensional logic. A sentence denotes a proposition and expresses a construction in the sense of Tichý´s definition . ‘Belief sentences’ refer to an attitude of some individual to the sense of the dependent clause, i.e., to the respective construction, which eliminates such problems as ‘paradox of omniscience’. In the case of empirical dependent clauses we can observe that at least besides this relation to a construction one can define a relation of the subject to (...) the state-of-affairs, represented by a proposition, i.e., by the denotation of the sentence. To stipulate such a kind of attitudes is justified by such cases where X says that he believes that Chicago is smaller than Prague and Y refers to this X’s belief saying that X believes that Prague is larger than Chicago. The article focuses on process management in public administration using the specific case study of the statutory city of Ostrava. Based on the selected part of the PAPRIS methodology, the process management is verified, and conclusions from the application of information system e-SMO are generalized. Ostrava is third the biggest city in Czech Republic with approximately 320 thousand citizen. Article describes experiences with SW implements, which are used for model of process in public administration. Particulary at local authority of Ostrava (...) town. Model of process is a basis for reengineering of process in state administration and preparation for implementation of big information systems. Mapping of process is providing implement and confirmation methodology to identify existing processes. Problem with its using consist in that, senior manager don’t informs, what organization is determination by processes. If are not described in given to organization current processes, or how would have had look new optimum processes, will not endeavour about reengineering successful. Procedural analysis namely offer tool and check methodology to identification current suit and it is possible him use either as instruction for reengineering function handling administrative and self-rule activities. Purpose of the article: The PAPRIS methodology was used when defining the objectives for implementation of the information system for public administration. This methodology has been elaborated by one of the authors and published in a very general scheme when solving many case studies,,. We assume that the PAPRIS is primarily a methodology with incorporated elements of procedural approach for project management in public administration information systems. The specific supporting process of communication between the client and the e-SMO system has been chosen for verification. The model of supporting communication process, created by ARIS tools, is crucial, and the structure of scripts is subsequently made. The aim of this article is to verify that the methodology is sufficient and appropriate to manage such a large project such, undoubtedly, is the e-SMO. Methodology/methods: Defined productive and non-productive processes with their defined process cuts represent a crucial category for the process structure of IS projects. This is fully accepted by the PAPRIS methodology. Process cuts are understood, in the logic modelling according to the PAPRIS methodology, as clearly defined logic directional cuts in three-dimensional space of all project processes. The process set is systemically categorized, in a given logic directional cut, into mutually disjoint process subsets, which are characterized by this particular directional operator. The directional operator always has a clear logical allocation that is based on the construction of a process view. Theoretically, an infinite number of process views can be used. One of the important issues in a methodology for the case studies includes the size of the research sample. It is usually assumed that there is no ideal number of cases and that the number between four and ten usually provides good results. Other authors defining against any quantitative standards for any determination of the sample size of the case studies, since such an approach denies the internal logic of this methodology and the richness of the information obtained from participants in the research. Research which is carried out using case studies does not aspire on compliance with the requirement the representativeness of the sample.. Methodology of case studies is among the established guidelines of qualitative research. Research on using case studies in the last 30 years has seen an extraordinary increase in social-scientific research, including research on business and management. Scientific aim: The essential aim of this study is to describe the way the process cut defines a productive process and non-productive process, in accordance with the PAPRIS methodology using the specific example. While the triggering mechanism of the project production process is an event causing its own production - i.e. the specific output with added value for the customer, the project of non-productive process is caused by the project management event. Therefore, it is caused by the need to control, monitor, track, inspect, evaluate outputs, decide and regulate the project implementation. Findings: Within the support of the communication process, two examples were used to verify the methodology. The global perspective on the process was created in ARIS tools and the communication between the call centre and the client was made in Visio tools. The PAPRIS methodology is based on the concept of process variability, which has been clearly formulated. The fundamental direction of the process development, anticipated changes and the opportunity to react to them in accordance with defined objectives of the PAIS project are guaranteed. (shrink)

We study the following open question in computable model theory: does there exist a structure of computable dimension two which is the prime model of its first-order theory? We construct an example of such a structure by coding a certain family of c.e. sets with exactly two one-to-one computable enumerations into a directed graph. We also show that there are examples of such structures in the classes of undirected graphs, partial orders, lattices, and integral domains.

The paper deals with the etymology of the personal names Qunï Säŋün and Toŋra Simä appearing in the ninth line of the Old Turkic Tonyukuk inscription. These names are borne by the envoys sent by the kagan of the Tokuz Oghuz to the Chinese and Khitan, respectively, to conclude a military alliance against the Turks. Both names have the same structure, a combination of an ethnonym vs. toŋra), referring to a tribal unit within the Tiele 鐵勒 confederation, and a title (...) of Chinese origin. Based on a thorough analysis of historical and philological data, the authors try to establish possible ethnolinguistic grounds for the Tokuz Oghuz mission, which have so far eluded researchers of the inscription and can be fully restored only in the light of the latest discoveries in the history and philology of Inner Asia of the Old Turkic period, e.g., the decipherment of the famous Khüis Tolgoi inscription from Mongolia. Cílem této práce je ukázat Fergusonovy základní teze týkající se pojetí lidské přirozenosti a zkoumat, jaké z nich plynou závěry a jestli mohou tyto závěry neproblematicky koexistovat. V první části práce se chci pokusit najít vnitřní jednotu ve Fergusonově teorii lidské přirozenosti a ukázat, že Fergusonovo pojetí člověka je konklusivní. Zkoumání přirozenosti člověka je pro Fergusona velmi těsně spjato se zkoumání vztahu jedince a společnosti. Právě v pojetí tohoto vztahu vzniká problémová situace, pokud budeme chtít podržet Fergusonovu verzi a přidat (...) k ní teorii morálního citu. Na rozbor této problematiky se zaměřím v poslední části práce. Práce se zabývá Fergusonovou teorií spadající pouze do období, kdy napsal "An Essay on the History of Civil Society". (shrink)

In [Laurence, Margolis 2003] the authors try - within their polemics against F.Jackson’s views in [Jackson 1998] - to decide the question whether concepts are a priori (in their formulation “to be defined a priori”). Their discussion suffers - as a number of similar articles - from a typical drawback: some problem whose solution requires an exact notion of concept is handled as if the latter were quite clear. The consequence of this ‘conceptual laxity’ is that a) the topic of (...) the discussion is not very clear (what does the phrase ‘concepts must be defined a priori’ mean?); b) the relevance of the Quinean criticism of the “second dogma of empiricism”, i.e., of Quine’s claim that “science sometimes overturns our most cherished beliefs” and therefore there is no sharp boundary between analytic and synthetic is uncritically accepted; c) no distinction is made between the question whether the relation between an expression and its meaning is a priori and the question whether the relation between a concept and the object identified by the concept is a priori. The present article intends to elucidate and then to answer the questions that can be asked when we say something like “concepts are a priori ”. (shrink)

Tento článek se zabývá Hayekovou teorií mysli, kterou představil ve svém pravděpodobně nejobtížnějším díle Sensory Order. První část nastoluje fundamentální otázku o vztahu vnějšího světa a obrazu, který si o tomto světě vytváří naše mysl. Následuje zkoumání základních nástrojů a předpokladů, na kterých Hayek svou teorii vystavěl. Jádrová část se pokouší nastínit hlavní odpovědi, které z Hayekovy teorie mysli plynou. Závěrečné části poté stručně rozšiřují možné využití tohoto díla ve filosofii vědy, v rozdílném chápání přírodních a společenských věd, v pojetí (...) svobodné vůle i v aplikaci na konkrétní oblasti ekonomie, ke kterým Hayek nejvíce přispěl. Studie má za cíl představit strukturu Hayekova evolucionismu. Argumentace postupuje v několika krocích: Východiskem je historicko- systematická expozice způsobu, jakým evoluční teorie ovlivnila Hayekovu filosofii, především s ohledem na periodizaci vývoje jeho myšlení a systematické odlišení explanans a explanandum v rámci jeho teorie vědy. Dále je rozebírán způsob, jakým Hayek rozvíjí svoji metodologii vědy. V této souvislosti je argumentováno ve prospěch teze, že Hayekovo pojetí metodologického dualismu je důsledkem ovlivnění evoluční teorií. Zároveň je evoluční teorie představena jako nástroj vysvětlení, konkrétně (...) pak tzv. vysvětlení vzorce. Následně je představeno Hayekovo pojetí společnosti v kontextu kulturní evoluce. Společnost je interpretována jako řád jednání a je kladen důraz na Hayekovo vnímání společnosti jako řádu vyvíjejícího se společně s lidskou myslí. Na základě těchto předpokladů je v poslední části rozvinuto Hayekovo pojetí mysli. Toto pojetí vychází z konekcionistické pozice. Dále argumentuji proti tradičnímu pohledu na Hayekovu filosofii jako rozvíjení Kantovy filosofie. Závěr rekapituluje základní body Hayekova evolucionismu. (shrink)

Levinstein recently presented a challenge to accuracy-first epistemology. He claims that there is no strictly proper, truth-directed, additive, and differentiable scoring rule that recognises the contingency of varying importance, i.e., the fact that an agent might value the inaccuracy of her credences differently at different possible worlds. In my response, I will argue that accuracy-first epistemology can capture the contingency of varying importance while maintaining its commitment to additivity, propriety, truth-directedness, and differentiability. I will construct a scoring rule — a (...) weighted scoring rule — and a global inaccuracy measure that has all four required properties and recognises the contingency of varying importance. I will show that Levinstein’s and my results coexist without contradicting each other. (shrink)

Este artículo aplica la crítica del isnad y el matn a las tradiciones relacionadas con el castigo del adúltero confeso en el Islam. Ante todo, intenta seguir la pista de las tradiciones relevantes hasta su fuente más temprana que es, en opinión del autor, Ibn ¿hihab al-Zuhri. A continuación, el artículo trata de averiguar los posibles contenidos de esta primera versión, que aparentemente carecía de referencias al nombre personal del adúltero o de alguna comprobación en cuanto a su estado mental (...) e ihsan. Se examina el papel de ¿Abd al-Razzaq al-San¿ani en la elaboración del matn y se analizan en detalle algunas versiones posteriores, tanto regionales como personales, del hadit original. En su parte final, el artículo estudia el requisito de la necesidad de una confesión cuádruple por parte del adúltero. El autor aporta fuentes que dan fe de una controversia entre ¿Abd al-Razzaq y Abu Dawud al-Tayalisi sobre el número de confesiones necesarias para la imposición de raym. (shrink)

The paper asks the question, whether nakedness embodies a potential wisdom. It deals with two different approaches to the phenomenon of nakedness: the first one rejecting, the second one appreciating the corporeality. The authors show different meanings the various cultures and civilizations attributed to nakedness, e.g. nakedness as a religious symbol of social subordination or belittling or of a specific national dominance . Attention is paid also to the meanings of nakedness in Jainism, where the nakedness is a symbol of (...) non-possessiveness; in Christianity, where the approach to nakedness is ambiguous, in tantrism with its vision of a person with numerous bodies, where the role of nakedness and sexuality is seen in cosmic context. Thus the meaning of nakedness remains multiple, depending on its context and visualization. The authors reject the pornography culture of contemporary society in favor of gymnosophy as the hierophany of the naturalness of nakedness. (shrink)

This essay poses the question whether it is possible, given the relationship of a subject and the method of its examination, at present as opposed to the time when Savigny worked, to talk about the same subject, and if it is not, what are the consequences for the interpretation of law. The turbulent history of Europe in the 20th century, marked by the cataclysms of world wars, genocides, expulsions and upheavals, therefore the necessity of new beginnings, jointly with other factors (...) (e.g. technological optimism) resulted not only in the ebbing of influence for religion, morality and tradition, but also in a deconstruction of law. This includes fragmentation, loss of the ability to formulate and interpret the purpose of law, as well as relativization of the traditional ordering principles of law (particularly the non-contradiction condition and contextual consistency, hierarchical structure, relative stability of law and its language). The opening of the texture of law, its deconstruction, creates a new segment of legislation, namely judicial law-making arising from the uncertainty of normative premises. (shrink)
